Contexte : La consommation excessive d'alcool est un problème majeur de santé publique en France et notamment dans les Pays de la Loire et en Bretagne. Elle serait un facteur favorisant les infractions pénales. Il existe un paradoxe, avec d'une part des consommations d'alcool qui sont considérées par les magistrats comme des circonstances aggravantes de l'infraction, et d'autre part, des données scientifiques qui établissent que dans certaines circonstances (dose, habitudes de consommation, contexte, polyconsommation...) l'alcool pourrait venir modifier le jugement, et donc le discernement du consommateur. Pourtant, au cours de la procédure pénale, l'expert judicaire peut être amené à se prononcer sur le degré de discernement de l'auteur d'une infraction commise sous l'emprise d'un état alcoolique. Le juge, même s'il n'est pas tenu à l'avis de l'expert, tient compte de ses conclusions. De cette manière, selon que le juge retient que le discernement était intact, altéré ou aboli au moment des faits, il décidera que l'auteur de l'infraction était, respectivement, responsable, partiellement responsable ou irresponsable. But de l'étude : Il est d'évaluer le degré de discernement (aboli, altéré ou intact) retenu par les experts psychiatres lors de la commission d'une infraction commise sous l'emprise d'un état alcoolique. Patients et méthodes : L'étude est rétrospective et multicentrique. Elle inclut les expertises pénales de responsabilité des psychiatres des Cours d'appel de Rennes et d'Angers sur la période du 1er janvier 2015 au 31 décembre 2016. Les critères d'exclusion sont les expertises pénales ne concernant pas la responsabilité pénale et les expertises pénales pour des infractions non-commises sous l'emprise d'alcool. Résultats : Nous avons exploré 529 expertises psychiatriques. Cent-quatre expertises ont été incluses. Ont été exclues les expertises ne correspondant pas à des expertises de responsabilité (expertise psychiatrique de victime, expertise de tutelle ou de curatelle, expertise de dangerosité post-sentencielle), les expertises pour lesquelles l'auteur des faits n'avait pas consommé d'alcool ou la donnée sur la consommation d'alcool n'était pas disponible. Sept experts psychiatres exerçant dans les régions Bretagne et Pays de la Loire ont participé à l'étude. L'analyse statistique n'a pas mis en évidence d'impact des consommations d'alcool sur le degré de discernement retenu par les experts. L'existence d'un trouble lié à l'usage de l'alcool chez l'auteur des faits n'était pas associée significativement à une atteinte du discernement. Par contre, la présence d'une comorbidité psychiatrique (p<0,001) et l'existence d'une prise en charge psychiatrique après la commission des faits (p<0,02) étaient associées significativement à une atteinte du discernement retenues par les experts. Conclusion : Une infraction pénale commise sous l'emprise d'alcool ne fait pas retenir par les experts une perturbation du discernement dans notre échantillon. ENGLISH: Context: Excessive consumption of alcohol is a major problem for public health in France and in particular in Pays de la Loire and Brittany. It is considered a factor encouraging criminal behaviors. There is a paradox between the alcohol consumption considered by judges as aggravating circumstances of the infraction on one hand and scientific data establishing that in certain circumstances (amount, consumption habits, background, polydrug use, ...) alcohol could change the judgment and discernment of the consumer on the other hand. However, during criminal proceedings, the expert psychiatrist may be called upon to assess the degree of discernment of the perpetrator of the committed infraction under the influence of alcohol. Depending on whether the judge pronounce an intact, an altered or an abolished discernment - after having taken into account the conclusions of the expert psychiatrist - the perpetrator of the infraction will be considered as entirely or partially responsible or as irresponsible. Goal: The goal is to assess the proportion of abolition or alteration of discernment that is proposed by psychiatrists when an infraction is committed under the influence of alcohol. Patient and methodology The study is retrospective and multicentric. It includes the criminal appraisals relating to the liability that have been performed by psychiatrists of the Courts of Appeal of Rennes and Angers over the period from the 1st January 2015 to the 31st December 2016. The exclusion criteria are criminal appraisals which do not relate to criminal liability and criminal investigations for infractions that are not committed under the influence of alcohol. Results: We browse 529 psychiatric appraisals and 104 of them were included. Appraisals that did not correspond to evaluation of responsibility (appraisals of victim, appraisals of guardianship or curatorship, appraisals of dangerousness after sentencing), appraisals for which author of the facts did not consume alcohol or data on alcohol consumption was not available, were excluded. Seven experts psychiatrists practicing in Brittany and Pays de la Loire did contribute to the study. The statistical analysis did not bring to light an impact of alcohol consumption on the degree of discernment assessed by the experts. The existence of an alcohol-related disorder in the perpetrator was not significantly associated with an impairment of discernment. On the other hand, the presence of psychiatric comorbidity (p<0,001) and the existence of a psychiatric care after the commission of the offense (p<0,02) were the only data significantly associated with an impairment of discernment. Conclusion: The consumption of alcohol during a criminal offense is not retained by the experts as a factor disturbing discernment. |
