The advent of the Internet has brought about dramatic changes in our day-to-day experience, simplifying and improving our daily lives. Nonetheless, like certain other aspects of this phenomenon, its ability to give any type of user access to any type of content at any time is a mixed blessing.
Even a minor, with a simple click of the mouse, can visit any sort of site, including sites featuring explicit content, selling illegal objects or selling drugs. This last point is the focus of the "S.O.N. - Save Our Net" Project. The purchase of drugs by minors over the Internet can no longer be constantly monitored by parents, not now that the online market can be accessed at any time, using any device. How can we, from a legal standpoint, combat this online market, the existence of which is by now well known? What regulatory instruments are at our disposal as we go up against the online sale of drugs to minors and, especially, the sale of the New Psychoactive Substances (NPS) that appeal most to this age group? The answer to this question is not only essential if we are to be able to fight against this type of trafficking and offer the public a more secure Web; it is also the purpose of this document. This document's objective is to make a comparison of legislative responses to drug trafficking in general, beginning with the traditional drugs, then juxtapose it with legislation on New Psychoactive Substances. Finally, it will determine what instruments are available and which would be ideal to use in the fight against online drug sales. |
