L'auteur, après avoir brièvement resitué le contexte historique international du contrôle des stupéfiants et du rôle, joué dans ce domaine, par les États-Unis, rappelle l'incidence de la problématique des drogues dans la politique en général. Il tente de clarifier ensuite l'organisation institutionnelle que représente l'Union Européenne à travers ses trois piliers que sont le traité de Maastricht, celui d'Amsterdam et les accords de Schengen. Certaines initiatives significatives prises consécutivement au traité de Maastricht à travers le Comité Anti-drogue (CELAD) sont ainsi citées à titre d'exemple. Le rôle et les prérogatives, en matière de lutte contre la drogue, de trois institutions européennes majeures (la Commission Européenne, le Conseil de l'Europe et le Parlement Européen) sont présentés. Ensuite, la véritable question de la prise de décision, de ses mécanismes, de sa formulation sociale et politique, de son impact mais aussi de ses limites inhérentes à un système souvent "bureaucratique", est abordée. Enfin un regard est porté sur les mesures actuellement entreprises au sein de l'Union Européenne, sur les actions conjointes, l'ajustement mutuel des législations et des pratiques ou encore sur le système de surveillance mis en place à l'égard des drogues synthétiques émergentes. Pour conclure, un bilan des plans d'action et des stratégies mis en place par la Commission Européenne et le Conseil de l'Europe est commenté. ENGLISH: Chapter 1 briefly reviews the wider historical background of international drugs control and the part that the us has played in it. It will also discuss the special role that the drugs issue sometimes plays in politics. Chapter 2 sets out to clarify the sometimes bewildering institutional framework of the EU. The idea is not to give a complete survey of the EU'S organisational setup - several books cover that territory - but to shed light on certain relevant areas. Few European citizens are at all familiar with the complex structure of the EU, such as the three "Pillars" of which it consists and the roles played by its different institutions, even though the decisions made there affect their lives. Many know the Maastricht Treaty, the Amsterdam Treaty and the Schengen Agreement by name, but few are familiar with their content. Chapter 2 also discusses some significant initiatives that the EU took prior to the Maastricht Treaty, through the anti-drug committee CELAD for instance. Chapter 3 focuses more on content. It describes the role and powers of the three institutions, the Commission, the Council and the European Parliament, and their involvement in drug-related matters. It also discusses the main groups that are active in this policy area. It concludes with an account of the power struggle in this area between the Commission and the Council, and seeks to establish where the power really lies. The heart of the study is chapter 4 on decision-making. It examines the question of how drugs have moved to such prominence on the political agenda and describes the bureaucratic mechanism that ensures that the issue stays there. It also looks at the content of the drugs issue and places it in a wider social and political framework. It discusses the customary approach to drugs within the EU's bureaucracy and the limitations of this approach. (Extract of the publication) |
