FRANÇAIS : Le gouvernement néerlandais a récemment proposé 2 mesures, jusque là considérées comme inacceptables : la distribution contrôlée d'héroïne et l'obligation de soin (sous forme d'un internement en centre résidentiel). Dans le premier cas, il s'agit d'un élargissement de la panoplie des interventions non-répressives, dans l'autre d'un durcissement des mesures de contrôle judiciaire. Des délinquants lourds, toxicomanes de longue date ayant commis de nombreux délits préfèrent généralement l'incarcération au traitement : la durée de la détention pour ce type de délits étant réduite. La proposition d'une mesure pénale devrait permettre de placer les délinquants toxicomanes dans un lieu de soins pour une période maximale de 2 ans. Des expériences de ce type à l'étranger indiquent que certains sujets réagissent positivement à ce "coup de pouce" pour entrer et rester en traitement. Une obligation de soins aurait chez ce type de population un effet positif sur la consommation, la criminalité et le comportement social. Cette nouvelle mesure semble aller à l'encontre de la philosophie néerlandaise en matière de répression de l'usage de stupéfiants, mais il s'agit en fait d'une approche pragmatique afin de vérifier dans la pratique l'éventuelle efficacité de ces mesures considérées jusque là comme inacceptables. ENGLISH : Recently two new options stretch the limits of the Dutch 'pragmatic' drug policy model. Both innovations, medical prescription of heroin and 'compulsory' admission into tre- atment are being tested experimentally. This article discusses thefeasability and some of the ramifications of 'compulsory treatment' within the Dutch drug policy context. Under the recently proposed new legislation drug-addicted offenders may be involuntary committed to an intramural treatment program for a maximum period of two years. Technically this new option is a penal law measure instead of a sanctions Therefore its application does not depend on the seriousness of the offence. All arrested addicted offenders with an extensive criminal history of drug-related crimes and who have at least served one prison sentence for such crimes may qualify for this new penal law measure. The results from mainly American and Swedish evaluation studies of compulsory treatment show coerced admission in a treatment program often has a positive effect on drug use, criminality and other social behaviour of older offenders with a long-standing drug-addiction. Most importantly there is little evidence that coerced admission in itself negatively affects the outcomes of treatment. Heroin prescription and compulsory, treatment are both directed at the most intransigent part of the drug problem, medically and socially highly problematic heroin addicts. Prescription of heroin is the ultimate consequence of harm reduction policy. Coerced admission into treatment implies the abandonment of the Dutch drug policy principle to refrain from repression of the use of illegal substances. It may be in line with pragmatism, however, to find out if hitherto 'impossible' solutions make any sense. |
