The violation of human rights in the war on drugs is a complex, international situation involving many actors, factors and concepts. In this chapter, we will focus on what is undoubtedly the most significant aspect in terms of impact on the lives of the people concerned, the death penalty. However, a clarification must at first be made as to what has been rapidly named, using the terminology used throughout the world by law enforcement authorities (States as well as certain international organizations particularly aimed at the cooperation of law enforcement agencies against criminal organizations): the war on drugs. This is not in fact a war on drugs - which, moreover, is on the rise all over the world in terms of use, trafficking, diversification of substances, etc., - but a war against individuals, users and traffickers, deprived of fundamental rights, in particular by the use of this expression which seems to justify all excesses.
