The long-standing international consensus on the criminalization of drugs is weakening. In recent years, the prohibitionist regime has been undermined by a variety of national reforms: decriminalization of illicit drug use, controlled distribution of heroin, legalization of cannabis and coca... These policies have been gaining ground in a growing number of countries. The principle established by the international community - according to which recreational use and trade in a number of psychoactive substances for non-scientific or medical purposes must be universally prohibited - nevertheless remains firmly established. This prohibition, which is enshrined in three international conventions, is at the heart of the drug control regime - the lineaments of which were laid under the aegis of the League of Nations, and which was consolidated within the framework of the United Nations.
The treaties now in force call on States Parties to criminalize the illicit trade in and illicit use of drugs. This obligation to use criminal law was amplified by the punitive turn that characterized the criminal policies of many Western countries from the 1980s onwards.
