Ce document se situe dans la continuité des travaux menés par l'OMS sur les législations en matière de santé, et représente à la fois une mise à jour et une extension du rapport publié en 1986 : "La loi et le traitement des personnes dépendantes à l'alcool et aux drogues.". Les analyses portent sur les politiques nationales en matière d'alcool et de toxicomanies et sur les programmes de traitement et de réinsertion. Elles comprennent des domaines qui n'avaient pas été étudiés auparavant, parmi lesquels : la législation relative à l'infection VIH et au sida ; à l'abus de solvants ; et les lois destinées à combattre la discrimination et à protéger les droits de l'homme. Cependant le champ de la prévention, pourtant considéré comme élément essentiel de la prise en charge des personnes dépendantes, n'est pas couvert ici ; sont également exclues de l'étude les questions législatives ayant trait, d'une part à la sécurité routière, d'autre part au soin et à la garde des enfants. L'approche est principalement axée sur la comparaison des diverses réponses politiques et législatives, et met en évidence la manière dont la législation peut promouvoir le traitement et la réhabilitation des personnes dépendantes. ENGLISH : This document forms part of the World Health Organization's continuing review and analysis of legislation on health matters that are likely to be of interest to Member States. As an update and expansion of a 1986 WHO publication, The law and the treatment of drug- and alcohol-dependent persons, it reviews legislation on compulsory legal commitment, treatment associated with the criminal justice system, and reporting, registration, laboratory testing and community surveillance. It analyses national drug and alcohol policies and programmes for treatment and rehabilitation. It also reviews developments in several areas that were not covered by the previous publication, including legislation relating to human immunodeficiency virus (HIV) infection and the acquired immunodeficiency syndrome (AIDS) as well as to solvent abuse, and measures to combat discrimination and protect human rights. This document is concerned with ways in which the law can serve to create and maintain effective treatment and rehabilitation programmes for both drug- and alcohol-dependent person. It concentrates on an analysis of the legal, administrative, scientific and clinical components of treatment and rehabilitation programmes. It is anticipated that, in the light of prior WHO studies and through comparative review of the policy, legislative and programme components, countries will be able to determine more effectively what changes, if any, are needed in these areas.
